Warranty
ThisLimitedWarrantygives theBuyer specific legal rights,andaBuyermayalsohave
other rights that vary from state to state.For aperiodof 365calendardays from thedate
of shipment,Valco InstrumentsCompany, Inc. (hereinafter Seller)warrants thegoods to
be free fromdefect inmaterial andworkmanship to theoriginal purchaser. During the
warrantyperiod,Seller agrees to repairor replacedefectiveand/ornonconforminggoods
orpartswithout charge formaterial or labor,or,at theSeller’soption,demand return
of thegoodsand tender repaymentof theprice. Buyer’sexclusive remedy is repairor
replacementofdefectiveandnonconforminggoods,or,at Seller’soption, the repayment
of theprice.
Sellerexcludesanddisclaimsany liability for lostprofits,personal injury, interruption
ofservice,or forconsequential incidentalorspecialdamagesarisingoutof,resuiting
from,orrelating inanymanner to thesegoods
ThisLimitedWarrantydoesnot coverdefects,damage,ornonconformity resulting from
abuse,misuse,neglect, lackof reasonablecare,modification,or theattachmentof im-
properdevices to thegoods. ThisLimitedWarrantydoesnot cover expendable items.
Thiswarranty isVOIDwhen repairsareperformedbyanonauthorized servicecenteror
representative. For informationabout authorized servicecentersor representatives,write
CustomerRepairs, Valco InstrumentsCompany, Inc,P.O.Box55603,Houston,Texas77255,
orphone (713)688-9345. AtSeller’soption,repairsor replacementswill bemadeon siteor
at the factory. If repairsor replacementsare tobemadeat the factory,Buyer shall return
thegoodsprepaidandbear all the risksof lossuntil delivered to the factory. If Seller
returns thegoods, theywill bedeliveredprepaidandSellerwill bear all risksof lossuntil
delivery toBuyer. Buyer andSeller agree that thisLimitedWarranty shall begovernedby
andconstrued inaccordancewith the lawsof theStateofTexas.
Thewarrantiescontained in thisagreementare in lieuofallotherwarranties
expressedor implied, including thewarrantiesofmerchantabilityandfitness for
aparticularpurpose.
ThisLimitedWarranty supercedesall priorproposalsor representationsoral orwritten
andconstitutes theentireunderstanding regarding thewarrantiesmadebySeller to
Buyer. ThisLimitedWarrantymaynotbeexpandedormodifiedexcept inwriting signed
by thepartieshereto.
